1. Agreement to these terms
These terms govern your use of The Pool Platform, including the website, the Business Owner web portal, the technician app and the pool owner app (the “service”), provided by Asav Dev LLC, a Florida limited liability company. By creating an account or using the service, you agree to these terms. If you use the service for a business, you accept them on its behalf.
2. Early access
The service is currently offered in early access to invited businesses. Features may change, be added or be removed while we improve the service, and we may limit or end early access at our discretion.
3. Accounts
- The business owner is responsible for the business account and for the technicians and other users it invites.
- Keep your sign-in details secure and tell us promptly about any unauthorized use.
- You must give accurate information and keep it up to date.
4. Your data
Your business keeps ownership of the information it enters, including client, pool and field records. You give us permission to host, process and display that information only as needed to provide and improve the service, as described in our Privacy policy. You are responsible for having the right to enter information about your clients.
5. Acceptable use
You agree not to:
- Use the service for anything unlawful, or to send spam or harmful content.
- Try to access accounts or data that are not yours.
- Interfere with the security or operation of the service, or reverse engineer it.
- Resell the service without our written permission.
6. Your relationship with your clients
Contracts, work orders, quotes and invoices created in the service are agreements between your business and your clients. We are not a party to them and are not responsible for the services your business performs or for disputes with your clients.
7. Fees and billing
The service is priced per pool serviced each month, as shown on our pricing page. Fees are billed monthly in advance or in arrears as stated at sign-up, and are non-refundable except where the law requires otherwise. Prices do not include taxes. We will give at least [30] days’ notice before changing prices.
8. Payments processed for you
Card payments from your clients are handled by our third-party payment processor and are subject to its terms. Processing fees, refunds and chargebacks follow the processor’s rules.
9. Availability and changes
We work to keep the service available, but it may sometimes be interrupted for maintenance or reasons outside our control. The technician app is designed to keep working offline and sync later; information that has not synced yet is stored on the device.
10. Ending your use
You can stop using the service and close your account at any time. We may suspend or end access if you breach these terms or if required by law. After closing, you can request an export of your data for [30] days, after which we may delete it.
11. Disclaimers
The service is provided “as is” and “as available”. To the extent allowed by law, we disclaim all warranties not stated in these terms, including fitness for a particular purpose. Water readings, routes and suggestions are tools to support your work, not professional advice.
12. Limitation of liability
To the extent allowed by law, we are not liable for indirect, incidental or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the fees you paid us in the [12] months before the claim.
13. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Broward County, Florida, and both parties consent to the jurisdiction of those courts.
14. Changes to these terms
We may update these terms. If changes are significant, we will notify you before they take effect. Continuing to use the service after that means you accept the updated terms.
